PO Box in a German Impressum: Allowed or Risky?

No, a PO box alone doesn't satisfy Germany's Impressum requirement. Section 5 DDG requires the address where you're established, and case law treats that as a serviceable address: one where documents can actually be delivered. A PO box isn't that. Listed alongside a full street address, though, it's fine.

That sounds clear-cut, yet PO boxes turn up in German Impressums constantly. Usually the reason is understandable: nobody wants their home address sitting in public on the internet. Here's how to fix that without inviting a cease-and-desist letter.

Why isn't a PO box a serviceable address?

A PO box is a locked compartment at a post office or mail center. Nobody is there to accept a letter on your behalf, and there's no mailbox a process server could use to deliver something.

That's exactly what matters here. Court documents get served formally. If the server can't hand the paper to the recipient in person, they put it in the mailbox at the home or business premises (Section 180 ZPO), or they deposit it and leave a notice (Section 181 ZPO). Both assume a place where you actually live or run a business. You can't serve a lawsuit on a PO box.

The same logic applies to an Impressum. German courts have repeatedly ruled that a bare PO box number doesn't meet the requirement. The Impressum exists so someone can sue you if they need to. A PO box defeats that purpose.

What happens if only a PO box is listed?

An incomplete Impressum is a competition-law violation in Germany. Competitors and certain industry associations can send a cease-and-desist letter (Abmahnung) over it, and that's the real risk in practice. A fine is possible too, though it's rarer.

A cease-and-desist letter usually means:

  • signing a declaration to stop, often with a contractual penalty for future violations,
  • covering the other side's legal fees,
  • a short deadline to respond.

The timing tends to sting: the letter often lands right as a solo founder's business starts gaining visibility online.

An example

Picture an illustrator in Leipzig who sells art prints through her own online shop as a side business. She rents an apartment in a multi-unit building and doesn't want her home address on her website, so she rents a PO box at the post office and lists only that in her Impressum.

A few months later, a law firm's letter arrives. A competing print shop has sent a cease-and-desist over the Impressum. She signs the declaration, pays the legal fees, and ends up listing her home address anyway, exactly what she was trying to avoid.

A business address with real mail acceptance from the start would have protected her home address and kept the Impressum valid at the same time.

A PO box as an addition: when is that fine?

Having a PO box isn't illegal. You can list it in your Impressum as long as a complete, serviceable street address sits next to it:

The street address satisfies the legal requirement; the PO box is just a convenience for your customers. It doesn't work the other way around: a PO box alone makes the Impressum incomplete.

What about a US-style PO box or a mailbox address?

Two things need separating here.

A classic PO box stays invalid, regardless of country.

A mailbox address with a street and house number can be enough. The Frankfurt am Main Higher Regional Court ruled in 2021 (case no. 6 U 150/19) that Section 5 TMG, the predecessor to today's Section 5 DDG, doesn't require a physical establishment with office space. What mattered was that service could reach the stated address.

For you, that means the address has to be a real street address where mail is reliably accepted. Whether a desk is waiting for you there is beside the point for Impressum purposes.

Does this apply in Austria too?

Yes, the outcome is the same. Section 5 of Austria's E-Commerce-Gesetz requires a geographic address where you're established. A PO box isn't a geographic address. Sites with media content also face an additional disclosure duty under Section 25 of the Mediengesetz.

If you're operating in the Austrian market, the same rule applies: a street address, not a PO box.

The alternative: a business address with mail acceptance

If you want to protect your home address and don't have an office of your own, you can rent a business address. What matters isn't the product's name but what's actually behind the address:

  1. Secure an address. Rent a business address with mail acceptance. With online identity verification, this usually takes a few minutes.
  2. Update it everywhere. Your Impressum rarely lives in just one place. Check your website, online shop, Instagram, LinkedIn, YouTube, marketplace profiles, terms, and cancellation policy. One forgotten old address on any channel is enough for a cease-and-desist letter.
  3. Keep the PO box, if you want. If customers are used to it, you can leave it listed as an additional postal address under the new one.

FAQ

Is a PO box a serviceable address? No. A serviceable address needs a place where documents can be delivered, a street address with a mailbox or someone to receive them. A PO box doesn't meet that.

Can I list a PO box in addition to my Impressum address? Yes. As long as a complete street address appears in your Impressum, you can add a PO box as a further postal address.
